Box 3 and real estate: why the form in which you own it matters more and more

The way wealth is taxed in box 3 (the Dutch tax bracket for private assets) will change over the coming years. For entrepreneurs who own rental property privately, this is not a detail: it directly affects the return you are left with.

Why this matters for property owners

As long as tax was levied on an assumed return, the actual income from a property did not determine the assessment. With a tax on the actual return, that changes: rental income and changes in value carry more weight, and so does the question of the form in which you hold the property.

Privately or through a BV

Placing real estate in a BV (the Dutch private limited company) shifts the tax from box 3 to corporate income tax (vennootschapsbelasting, VPB). Whether that works out better depends on the size of the portfolio, the financing, and what you want to do with the return: pay it out or reinvest it. It is a case-by-case assessment, not a general rule.

What you can do now
